Rule 10:
Requirement to openly advertise

Primary requirement

  1. Wherever possible, agencies must use open competitive procurement processes to give all interested suppliers the opportunity to compete.

Application

  1. Agencies must:
    1. use procurement approaches that are proportionate to the value, risk and complexity of the procurement that will achieve public value.
    2. openly advertise on the Government Electronic Tenders Service (GETS):
      1. if the maximum total estimated value of the procurement meets or exceeds $100,000 for goods, services or refurbishment works, or $9 million for new construction works, and
      2. when there is no exemption from open advertising (Rule 12).
    3. list the contract opportunity on GETS, including
      1. attaching the Notice of Procurement (Rule 17) and provide access to all relevant documents free of charge.
    4. include the following basic information in its GETS listing:
      1. the agency’s name
      2. the name of the contract opportunity
      3. the type of procurement process (e.g. Request for Tender)
      4. the relevant GETS tender watch code/s
      5. the deadline for responses from suppliers
      6. the address for enquiries and the name of the contact person
      7. a list of any other documents that are not available on GETS and details of how suppliers can get them.

Government Electronic Tenders Service (GETS)

The Government Electronic Tenders Service (GETS) is a free service. It supplies information about New Zealand government contract opportunities and promotes open, transparent and fair competition. MBIE manages GETS on behalf of the New Zealand government.

GETS 

Any reference to GETS here includes any replacement e-procurement system.

GETS is accessible to all interested suppliers, both domestic and international.

Agencies may advertise using other media, as well as GETS.

Where agencies use GETS to receive tender responses, they should not require the supplier to also provide the tender response by email or hardcopy.

Open competitive processes that comply with the Rules include:

  • one-step processes such as a Request for Quote or Request for Tender
  • multi-step processes, such as a Registration of Interest followed by a shortlisting, then a Request for Proposal or Request for Tender
  • outcomes-based contracting
  • relational contracting
  • lean agile procurement
  • collaborative contracts
  • competitive dialogue
  • commissioning
  • social investment contracting.

Options for approaching the market

Social sector commissioning and social investment outcome contracts

Some government agencies, in particular those that support the delivery of social services, use commissioning to engage providers. Commissioning is where the people that benefit from or deliver the goods or services are also involved in designing them.

The Rules apply to goods and services designed and/or delivered through commissioning models and social investment outcome contracts, where the provider is a non-governmental organisation or third party.

Definition of GETS listing

The summary of a contract opportunity published on GETS. It includes key information such as the:

  • name of the buying agency
  • approach to market process that will be used (e.g. Request for Proposals)
  • deadline for responses
  • address for any enquiries.
